MTC National Nexus Program Announces. . .
“Online Marketplace Seller Voluntary Disclosure Initiative”
There are 23 states, plus the District of Columbia, that are participating in this limited time Voluntary Disclosure Program which began August 17, 2017 and will run through October 17, 2017.
The majority of the participating jurisdictions have agreed to waive sales/use tax and income/franchise tax, back-tax liability, plus penalties and interest based on eligibility. These taxes will be waived for prior tax periods, without respect to any look-book periods, given that the taxpayer registers as a seller or retailer.
- Taxpayer is an online seller with nexus in a participating state due to having inventory located in a fulfillment center/warehouse in that participating state, operated by a “marketplace provider or facilitator.”
- Taxpayer has not previously registered with the state tax authority, filed returns with or made payments of tax to the state.
- Taxpayer timely completes online voluntary disclosure application electronically, following the steps required by the MTC.
- Taxpayer must agree to collect and remit applicable sales and use taxes and to file and pay any appropriate income or franchise taxes beginning no later than December 1, 2017.
The 24 states/jurisdictions include: Alabama, Arkansas, Colorado, Connecticut, District of Columbia, Florida, Idaho, Iowa, Kansas, Kentucky, Louisiana, Massachusetts, Minnesota, Missouri, Nebraska, New Jersey, North Carolina, Oklahoma, South Dakota, Tennessee, Texas, Utah, Vermont, and Wisconsin.
